Benicia has new rules for sidewalk vendors. The City Council adopted the ordinance 4–1 on July 21, with Mayor Steve Young voting no, according to approved minutes; the staff report said it takes effect 30 days after adoption. Vendors need a one-year city permit, renewed annually, and food carts need county health approval. Vendors must display both permits, keep the area clear of trash, follow approved hours and cart-size limits, and may not sell alcohol, cannabis or tobacco. Stationary vendors cannot set up in residential-only zones, though roaming vendors can stop there to make sales. Food vendors cannot operate next to a permitted farmers' market or special event, or block wheelchair access on sidewalks. Under state law, violations bring fines, not criminal charges.
